What Should I Do if I’ve Been Arrested For Growing Marijuana?

In the state of Florida, it is a crime to sell, cultivate, or distribute marijuana. Although the state’s

climate provides an ideal growing environment, to do so places you at risk for criminal charges. It’s also important to note that it’s illegal to maintain a property where cannabis cultivation is taking place.

The penalties for growing marijuana depend on the amount manufactured, and whether-or-not you were in a drug-free zone, like a church or school:

Penalties for growing or being found in possession of marijuana vary on the amount in question. Typical penalties include:

  • 20 grams: Misdemeanor charges punishable by a maximum of one year in jail and a maximum fine of $1,000.

  • 25 pounds or less: Felony charges punishable by a maximum of five years in prison and a maximum fine of $5,000.

  • 25 to 2,000 pounds (300 – 2,000 plants): Felony charges punishable by a mandatory minimum sentence of three years in prison and a maximum fine of $25,000.

  • 2,000 to 10,000 pounds (2,000 – 10,000 plants): Felony charges punishable by a mandatory minimum sentence of seven years in prison and a maximum fine of $50,000.

  • 10,000 pounds (or 10,000 plants or more): Felony charges punishable by a mandatory minimum sentence of 15 years in prison and a maximum fine of $200,000.

Distribution or cultivation within 1,000 feet of a school, college, park, public housing, daycare center or church is considered a felony, and is punishable by a maximum of 15 years in prison and a maximum fine of $10,000.
