Police Mock Woman Hiding Drugs In An Unusual Place

Unfortunately, Florida has a significant problem with drug usage and drug dealing, with one offense feeding the other. However, in this day and age, a person who is caught possessing or dealing drugs not only has to contend with the legal process, but may also face mockery on social media. The Brevard County Sheriff made a post on the Department’s Facebook page commenting on an ongoing case, subjecting a defendant to social stigma ahead of their legal case.

Caught With Illegal Drugs

The sheriff told the story of a woman stopped at a gas station in Mims, south of Daytona Beach, who attempted to hide a bag of illegal drugs after falling asleep at the wheel of her car. A search was made of the car, and the bag was discovered, containing methamphetamine, fentanyl, buprenorphine, and other drugs. The woman was arrested and taken into custody, where she was searched, and another small bag of fentanyl was found in a private place on her body.

Florida’s drug laws are extremely severe, primarily as a result of its past history of readily available illegal drugs. The woman will likely face charges of drug possession for each substance, which can result in a sentence for each charge – often, to be served consecutively (in order), rather than concurrently (at once). Bringing contraband into a correctional facility is an additional felony charge. However, not all cases of drug possession are so clear-cut, and if you have been charged with the same offense, hopefully you have not attempted to conceal the drugs in the same intimate place.

Even simple possession of many drugs will result in a felony charge in Florida, often with a mandatory minimum sentence of three years in prison. If you have multiple charges, like the woman in Mims, those sentences can add up – but even if the evidence against you appears solid, you do not have to simply accept time behind bars.

For example, it may be possible to show that the search executed to obtain the evidence in your case violated your Fourth Amendment rights, or that law enforcement exceeded their brief. Another common defense in drug cases is that you did not exercise control over the substance in question (in order to have true possession of a substance, the person in question must have had control or ‘dominion’ over the drugs).
